Welcome to Kalavastha.com (“Kalavastha”, “we”, “our”, “us”). These Terms of Service (“Terms”) govern your access to and use of Kalavastha.com and any related features, including community weather voting and location-aware displays (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms.

1) Acceptance of Terms

Your use of the Services constitutes acceptance of these Terms and our Privacy Policy. If you do not agree, do not use the Services.

2) Changes to the Services & Terms

We may modify the Services, update datasets, change UI components, or amend these Terms at any time. Material changes will be indicated via the “Last updated” date above. Your continued use after changes signifies acceptance.

3) Eligibility

You must be at least 13 years old (or the age of digital consent in your region) to use the Services. If you use the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

4) Accounts and Security

Some features may require creating an account or submitting contact details. You are responsible for maintaining the confidentiality of any credentials and for all activities under your account. Notify us promptly of any unauthorized use or suspected breach.

5) User Contributions (e.g., Weather Votes, Comments)

• Ownership & License: You retain any rights you hold in your submissions. By submitting content, you grant Kalavastha a worldwide, non-exclusive, royalty-free license to host, store, display, reproduce, and create derivative visualizations for the purpose of operating and improving the Services.
• Accuracy: Only submit information you believe to be accurate. Weather votes are aggregated and may be displayed publicly and used to improve local status indicators.
• Prohibited Content: Do not submit content that is unlawful, abusive, defamatory, hateful, harassing, pornographic, or infringes others’ rights; do not spam or manipulate results.

6) Acceptable Use

• No reverse engineering, scraping, crawling at scale, or interfering with normal operation.
• No attempts to bypass rate limits, security controls, or access non-public areas.
• No using the Services for emergency decision-making, disaster response, or life-critical applications. Always consult official sources.

7) Location Data & Browser Permissions

With your consent, we may use your browser’s approximate geolocation to tailor local views. Location permission is optional and can be revoked in your browser. We do not store precise coordinates beyond your session as described in our Privacy Policy.

8) Data Sources, Accuracy & Availability

• The Services combine multiple inputs (public feeds, third-party APIs, and community votes). Weather conditions can change rapidly and may be inaccurate or delayed.
• The Services are provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, including fitness for a particular purpose or non-infringement.
• We may suspend or limit features for maintenance, security, or operational reasons.

9) Third-Party Links, Ads & Affiliates

We may display links to third-party sites, advertising (including programmatic ads), or affiliate offers. We do not control and are not responsible for third-party content, policies, or practices. Your interactions with third parties are solely between you and the third party.

10) Intellectual Property

All content and materials on the Services (including UI, design elements, graphics, and compiled datasets) are owned by Kalavastha or our licensors and protected by applicable laws. You may not copy, modify, distribute, or create derivative works except as permitted by these Terms or applicable law.

11) Copyright Complaints

If you believe content on the Services infringes your copyright, contact us with sufficient detail to identify the material and your ownership claim. We may remove content at our discretion and, when appropriate, notify the submitting user.

12) Disclaimers

• No Professional Advice: The Services are informational only and not a substitute for official weather alerts, government advisories, or professional guidance.
• Beta Features: Experimental features may contain bugs and may be modified or removed without notice.

13) Limitation of Liability

To the fullest extent permitted by law, Kalavastha and its affiliates, officers, employees, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from or related to your use of the Services.

14) Indemnification

You agree to indemnify and hold harmless Kalavastha and its affiliates from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Services, your content, or your violation of these Terms or applicable law.

15) Termination

We may suspend or terminate your access to all or part of the Services at any time, with or without notice, for any reason, including violations of these Terms. Upon termination, provisions intended to survive (e.g., intellectual property, disclaimers, limitations of liability, indemnification, and governing law) will continue in effect.

16) Governing Law & Venue

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of laws principles. You consent to the exclusive jurisdiction and venue of the courts located in Ontario, Canada, for all disputes arising out of or relating to the Services.
